What Is SSDI?
Social Security Disability Insurance is program that is designed to help hard working Americans get compensation when they cannot work due to a disability. You are eligible for SSDI if you have a recognized disability, which keeps you from working for at least a year, and have work for about 5 of the last 10 years prior to your disability. The system pays you a percentage of the amount of money you would have been earning if you didn’t become disabled.
What Are Past Due Benefits?
Past due benefits are a percentage of the amount of money that you would have earned during the period that you could not work. In 2013, the average person received $1,222 per month for disability benefits.
The lawyers at our firm have gotten many large awards for our Social Security Disability clients. In 2014, we obtained a $60,000 award for a disabled client. Our fee was $6,000, which is the most we will ever charge anyone for a Social Security Disability case. Read more
How Are SSDI Claims Processed?
After submitting a claim to the Social Security Administration (SSA), you are in the “initial” stage of your application. The vast majority of claims are denied at the initial level. If you are denied at the initial level, you can ask the SSA to reconsider your claim. This is called the “reconsideration” stage of your application. Almost all reconsideration claims are also denied.
You can then file an appeal so that your claim will be reviewed by a judge. This is the longest stage of the process, sometimes taking over a year before you are given a hearing date. When you are given a hearing date, you will want a lawyer to be with you so that you can be properly represented in front of the judge. Your claim is twice as likely to be awarded if you have a lawyer representing you.
What Is a Disability?
A disability is a physical or mental impairment that is expected to last more than one year, or result in death, which prevents that person from engaging in any substantially gainful activity. One of the main things that the SSA looks for to determine a disability is whether or not you can walk comfortably.
