Each year, nearly 400,000 Americans are hospitalized with some
type of head injury. Of these victims, approximately three quarters
or 300,000 individuals are diagnosed with mild to moderate brain
damage, injuries that can be subtle, persistent, and potentially
long term.
What is a Traumatic Brain Injury
Traumatic brain injury, or "TBI," is a term used by
lawyers to indicate "head injury" or "brain injury." All
of these terms refer to the fact that the brain has undergone
a physical assault, whether it is the result of a motor vehicle
accident, a fall, a recreational or sports-related activity,
or a blow to the head. Most traumatic brain injuries occur as
the result of motor vehicle accidents.
Traumatic Brain Injuries may affect physical abilities, thinking,
and emotions and behavior. Physical difficulties may include
headaches, paralysis, and loss of muscle control. Victims of
brain injuries may have difficulty with their memory and may
find themselves unable to concentrate. Personality changes often
follow the injury including mood swings, depression, and fits
of anger.
Treatment involves diagnostic testing, drugs, and, at times,
surgery, but rehabilitation is a very important aspect to the
injured person's maximum recovery. Quite often a patient's treatment
team will include a neurologist or neurosurgeon, a physiatrist,
a neuropsychologist, and various therapists including physical,
occupational, and speech therapists. It is important that friends
and family of the patient also actively participate in their
care by establishing a routine and communicating with the injured
individual to help them overcome their frustration.
When TBI results from someone's culpable conduct, the injured
person is entitled to seek compensation for damages due to the
injury.
What to do if you or a Loved One has Suffered a Traumatic Brain
Injury
An experienced personal injury legal practitioner is of the
utmost importance for the TBI patient, to formulate a plan of
action, which will result in ensuring a lifetime of medical and
therapeutic help. The physical, emotional, and cognitive damages
from TBI can be as devastating as any more recognizable bodily
injury. Just as organically based physical paralysis can incapacitate
an individual, frequent severe headache, substantial emotional
or intellectual impairment can also cause disability. And, as
with any serious injury, the victim's family and friends invariably
share in the suffering.
Although proving emotional or cognitive injuries stemming from
a head injury can be challenging, such a task is feasible in
the hands of an experienced attorney.
